About Nails.net.au

Nails.net.au is an independent entity set up to promote the various artistic projects of the artist Niels 'Nails' Oeltjen. This online store sells the work of the artist, as well as other projects he has initiated. When creating our edition products we strive to use small-scale producers or work in collaboration with other artists and craftsmen.

Orders

The sale of all items via Nails.net.au's online store is subject to availability. Size information is provided as a guide only. When making an order using the online forms you must follow all the instructions and provide all information required. All prices, taxes, the volume of items and any other details included on the online forms apply to your purchase. Nails.net.au will send your purchase and any communications to you at the contact details you provide on the order form, and will not be responsible for any errors in this information. You will be sent an email confirming your order and receipt of payment. Nails.net.au is not a wholesaler and any entity who resells the goods provided by this store without the written permission of Nails.net.au is in violation of the conditions of this online store. Nails.net.au may prosecute offenders to the full extent of the law.

Payment

All prices are in Australian dollars. Payment of the correct price must accompany all orders. Prices are subject to change without notice, however you will only pay the price that is advertised for the item at the time you place your order. Items advertised as 'on-sale' are only available at the reduced price during the sale period. PayPal™ is our secure payment gateway and our customers and Nails.net.au are bound to the terms and conditions as stated by PayPal™.

Taxes

Prices for items sold within Australia include Australian Goods and Services Tax ('GST'). Prices for items sold outside of Australia do not include GST. If you are making your purchase from outside of Australia you must pay any local duties or taxes (eg. customs or import taxes) that apply in your country of purchase — Nails.net.au does not take responsibility for these.

Postage

Postage and Handling Australian Delivery
Australian orders are sent via Australia Post.

International Delivery
International orders are sent via Australia Post. Nails.net.au does not take any responsibility for meeting any legal requirements of the country of delivery.

Delay in Delivery

Delay may occur as a result of factors such as supply problems or unexpected demand, however, Nails.net.au will endeavour to despatch your order within 7 working days of purchase.

Cancellation

Nails.net.au may cancel your order if an item is unavailable or if there is an error in the price or description of the item, or in the order. If your order is cancelled Nails.net.au will refund your payment.

Refusal of Sale

Nails.net.au reserves the right to cancel any order for any or all of the following reasons:

If we believe that order may constitute an attempt to commit a fraudulant act.

B
If we believe that it is an attempt to buy our goods in order to sell them on.

C
If the purchaser has been previously been banned from our store for improper conduct. Bans are binding until notice is given by us lifting the ban.

If your order is refused Nails.net.au will refund your payment.

Bans

Nails.net.au reserves the right to ban from using our store any individual, company, group, collective, or any other entity who contravenes our terms and conditions. It is the responsibility of the banned entity to prove their case should they wish to be removed from the banned list.

Returns and Exchanges

Nails.net.au will refund, credit or exchange items if you return them to Nails.net.au at the address specified below, at your expense in original condition and in original packaging, together with a copy of your proof of purchase, within 30 days of delivery of your order. Nails.net.au will only accept returned items if accompanied by a letter stating why the goods are being returned. Nails.net.au will only refund or exchange purchases after 30 days if the item purchased is defective. Delivery and packaging charges are not refundable unless Nails.net.au sent the item in error or you received it in a faulty or damaged condition. If you wish to exchange an item because you ordered it in error or have changed your mind you must pay the charges for packaging and delivery of the newly ordered item. Refunds

Nails.net.au will refund your payment if the item you wanted to purchase is unavailable. Refunds will be made to the credit card account used to place the order and no other.

Exclusion and Limitation of Liability

Nails.net.au excludes all representations, terms and conditions relating to your purchase from the Nails.net.au online store, apart from those in the Conditions of Use. Nails.net.au will not be liable for any indirect, incidental, special and/or consequential losses or damages or loss of profits whatsoever (including arising from any act or omission by Nails.net.au) in connection with your use of or inability to access the online store or make a purchase, or any material or information or product purchased from the online store. To the extent permitted by law Nails.net.au excludes all statutory or implied conditions and warranties and limits Nails.net.au's liability under any condition or warranty which cannot legally be excluded to, at Nails.net.au's discretion, resupply of the goods or services (or equivalent) or payment of the cost of having the goods or services resupplied. The functions of Nails.net.au's online store may sometimes be interrupted by server outage and technological problems. While Nails.net.au will make reasonable efforts to ensure continuous online services Nails.net.au does not take any responsibility for any inconvenience or consequences affecting your order, including the loss of your order.

Nails.net.au uses a contracted service provider to securely process your online credit card payments. This provider is the PayPal. When you purchase an item from Nails.net.au's online store your credit card details are only processed by Nails.net.au's contracted service provider and Nails.net.au does not record or store this information. While Nails.net.au contracts with a service provider to provide a secure system Nails.net.au does not and cannot take responsibility for the security of information during transit over the internet.

Personal Information

Nails.net.au collects your personal information when you make a purchase via our PayPal page to help to process your order. Nails.net.au may disclose your shipping information to Australia Post for the purposes of delivering your order. Nails.net.au also retains your order details (but not credit card details) in a secure offline system to help manage any returns, refunds or exchanges. Nails.net.au collects and uses your personal information under the terms of the Nails.net.au terms and conditions.

Your personal information is collected to enable us to process your order. Nails.net.au will not share (ie sell, rent, trade, or disseminate) your personal information with any third parties or any other entities. We will only use your information for our business purposes, and will treat your information as private. We are committed to protecting your privacy.
